These Terms of Service ("Terms") govern your use of NorthLog, including the NorthLog apps for iOS, iPadOS, Android, macOS and Windows, the website at northlog.ca, and related services (together, the "Service"). By creating an account, starting a free trial or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are

NorthLog is made by MotionSM ("NorthLog", "we", "us"). MotionSM and NorthLog are registered business names of Motion Social Marketing Inc., a corporation registered in Ontario, Canada. You can reach us at support@northlog.ca.

2. Who can use NorthLog

  • You must be at least 18 years old, or the age of majority where you live, to create an account.
  • If you use NorthLog on behalf of a company or organization, you confirm you are authorized to accept these Terms for it, and "you" includes that organization.
  • You are responsible for keeping your login secure and for all activity under your account. Tell us right away at support@northlog.ca if you think your account has been accessed without permission.

3. What NorthLog is, and what it is not

NorthLog is a record-keeping tool for drone (RPAS) pilots and operators. It helps you log flights, track aircraft, batteries, maintenance and pilot certificates, and export records such as PDF logbooks.

You remain responsible for your own regulatory compliance. NorthLog does not provide legal, regulatory or aviation safety advice, and using NorthLog does not by itself make you compliant with the Canadian Aviation Regulations, FAA rules, or any other law. You are responsible for:

  • checking that every record NorthLog creates or imports (including records imported automatically from your drone, controller or email) is complete and accurate;
  • keeping the records your regulator requires, for as long as it requires them; and
  • operating your aircraft safely and legally.

NorthLog is an independent product. It is not affiliated with, endorsed by, or sponsored by Transport Canada, NAV CANADA, the FAA, DJI, AIM Robotics / RPAS WILCO, Apple, Google or Microsoft. Their names are used only to describe compatibility.

4. Plans, trials and billing

Plans. NorthLog offers a Free plan and paid plans, including Pro (for individual pilots) and Organization (for teams, billed per pilot, with a minimum number of pilots). Current prices and plan features are shown on northlog.ca and in the apps. Prices do not include applicable taxes, which are added where required.

Free trial. Paid plans may include a 7-day free trial. A payment method is required to start a trial. If you do not cancel before the trial ends, your subscription starts automatically and you will be charged the plan price for the first billing period. You can cancel at any time during the trial and you will not be charged.

Automatic renewal. Paid subscriptions renew automatically at the end of each billing period (monthly or annual) until you cancel. By subscribing, you authorize us (or the app store you purchased through) to charge your payment method at each renewal.

Where you buy matters.

  • App Store and Google Play purchases are processed by Apple or Google and are also subject to their terms. You manage and cancel these subscriptions in your Apple or Google account settings, not through us.
  • Web purchases (including Organization plans) are processed by Stripe. You manage and cancel these in the billing portal linked from your account or from your receipt.

Organization seats. Organization plans are billed per pilot seat. When seats are added during a billing period, the added seats may be charged on a prorated basis for the remainder of that period. The plan's minimum number of seats applies at all times.

Price changes. We may change prices. We will give you at least 30 days' notice before a price change affects your subscription, and the new price applies from your next renewal. If you do not agree, you can cancel before it takes effect.

Discount and partner programs. We may offer special pricing (for example, for volunteer search and rescue teams or public safety agencies). Such pricing is subject to the program terms communicated to you, may require agreed-upon conditions, and may end when a program ends.

5. Cancellation and refunds

  • You can cancel a paid plan at any time. Cancellation takes effect at the end of your current billing period, and you keep access to paid features until then.
  • We do not offer refunds for partial billing periods, unused time or renewals, because every paid plan includes a free trial you can use to evaluate NorthLog first. This does not limit any refund rights you have under applicable consumer protection law.
  • App Store and Google Play purchases are subject to Apple's and Google's refund policies. Refund requests for those purchases must be made to Apple or Google.
  • If your paid plan ends, your account moves to the Free plan (or is closed, if you choose). Ending a subscription does not delete your records (see section 8).

6. Organization accounts

  • The person who creates or administers an Organization account (the "Admin") controls it. The Admin can invite and remove pilots, assign roles, and view and export the organization's records.
  • Pilots who join an Organization understand that the Admin can see the records they create inside that Organization.
  • The organization is responsible for its members' use of NorthLog and for having any consents it needs from its pilots.
  • When a pilot is removed from an Organization, the records they created for that Organization stay with the Organization.

7. Connected services and devices

Some features connect to third-party services or devices, such as:

  • Gmail or Microsoft Outlook, with your permission, to find and import flight authorization emails (for example RPAS WILCO survey or mission reports). We request read-only access and use it only to provide that feature. You can revoke access at any time in your Google or Microsoft account settings.
  • DJI controllers and flight logs, to import flight records from your device.

These third-party services are governed by their own terms. They can change or stop working without notice, and we are not responsible for their availability or for changes they make that affect NorthLog features.

8. Your data

  • You own your data. Flight logs, maintenance records, certificates and other content you add to NorthLog ("Your Content") remain yours.
  • You give us a limited licence to store, process, back up, sync and display Your Content only as needed to provide and improve the Service for you.
  • You can export your records at any time using the export features in the apps.
  • You can delete your account at any time from the app or at northlog.ca. Cloud data is deleted within 30 days of account deletion, as described in our Privacy Policy. Before deleting, export any records you are legally required to keep.
  • How we collect, use and protect personal information is described in our Privacy Policy at northlog.ca/privacy, which forms part of these Terms.

9. Acceptable use

You agree not to:

  • use the Service for anything unlawful, or to create false or misleading flight or maintenance records;
  • access another person's account or data without permission;
  • attempt to probe, disrupt, overload or bypass the security of the Service;
  • copy, resell, reverse engineer or build a competing product from the Service, except where the law expressly allows it; or
  • use automated tools to scrape or extract data from the Service.

We may suspend or close accounts that break these rules.

10. Our intellectual property

The Service, including its software, design, logos and the NorthLog name, belongs to MotionSM and its licensors. These Terms give you a personal, non-exclusive, non-transferable right to use the Service while your account is active. No other rights are granted.

If you send us feedback or suggestions, we may use them without any obligation to you.

11. Availability and changes to the Service

We work to keep NorthLog available and reliable, but we do not guarantee it will be uninterrupted or error-free. NorthLog works offline and syncs when you reconnect. You are responsible for keeping your devices and apps up to date. We may add, change or remove features. If we remove a major paid feature, we will tell you in advance.

12. Disclaimer

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that records created, imported or exported through NorthLog will be accepted by any regulator, auditor or insurer.

13. Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, or for regulatory fines or penalties, arising from your use of the Service.
  • Our total liability for all claims related to the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or CA$100 if you have not paid anything.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnity

If you use NorthLog for business, you agree to defend and indemnify MotionSM against claims arising from your breach of these Terms, your flight operations, or Your Content, except to the extent caused by our own breach.

15. Suspension and termination

You can stop using NorthLog and delete your account at any time. We may suspend or terminate your access if you seriously or repeatedly breach these Terms or fail to pay, or if the law requires it. Where reasonable, we will give you notice and a chance to export your records first. Sections 3, 5, 8, 10, 12, 13, 14 and 16 survive termination.

16. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be handled in the courts of Ontario, unless consumer protection law where you live gives you the right to bring a claim elsewhere.

17. Changes to these Terms

We may update these Terms. If a change is material, we will notify you by email or in the app at least 30 days before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms.

18. General

  • If any part of these Terms is found unenforceable, the rest stays in effect.
  • Not enforcing a right is not a waiver of it.
  • You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
  • These Terms, together with the Privacy Policy and any plan or program terms you agree to, are the entire agreement between you and us about the Service.
